Article 36 explained in plain English
This article regulates the allowances of the members of two committees in the law, and gives each a different body to set its allowances.
1. The committee for considering violations (Article 34)
- The allowances of its members are set by decision of the Minister.
- Under Article 34, this committee is formed by the Minister from three members, including a legal adviser and one of the members of the Authority's board of directors from among the accredited valuers, and it considers violations of the law and imposes the penalties in item (first) of Article 32 other than imprisonment, subject to Article 33.
2. The Valuers Registration Committee (Article 7)
- The allowances of its members are set by decision of the board.
- Under Article 7, this committee is formed at the Authority by decision of the board from three members, including a legal adviser, and decides on applications for registration in the register.
The logic of the distribution: the body that forms the committee is the one that sets its members' allowances: the Minister forms the violations committee and sets its allowances, and the board forms the registration committee and sets its allowances.
Amendment: the words “and the board shall determine, by its decision, the allowances of” were added before the words “the members of the Valuers Registration Committee” by Royal Decree No. (M/190) dated 22/11/1444 AH.
Relationship to Article 37: alongside this article is Article 37, which allows a person whose license or membership has been cancelled, or whose registration has been struck off, to apply for a new license or membership or to be re-registered after 3 years from the date of the decision to cancel or strike off.
The article is organizational, concerns the two committees, and creates no obligations on valuers or clients.
