Article 34 explained in plain English
This article adds two powers to what is held by the committee referred to in Article 33, which is the committee the Minister forms to hear violations of the Law and the Implementing Regulations other than Article 29 violations. These two powers come in addition to the penalties in Article 32 (a fine of up to ten million riyals, suspension of the license or permit for up to six months, or their cancellation).
1- Daily fine:
- It is imposed for each day the violator continues his violation.
- It is no more than 10% of the amount of the fine stated in paragraph (1) of Article 32.
- It is calculated from the date the decision specifies.
2- Publishing a summary of the decision:
- At the violator's expense.
- In a local newspaper published where he resides, or if there is none, in the nearest region to him, or by any other suitable means.
- According to the type of violation, its gravity and its effect.
- Publication takes place after the decision becomes final after the period set by law has passed, so the decision is not published before it becomes final.
The period set by law for challenging the committee's decisions under Article 33 is sixty days from the date of notification of the decision before the competent court.
The daily fine is a tool to push the violator to stop the violation quickly, because each day of delay adds to it. Article 35 requires the violator to remove the effects of the violation, carry out rehabilitation and pay compensation.
Anyone against whom a decision including a daily fine or publication has been issued should consult a lawyer specialized in administrative matters.
Practical example
The violations committee decided to fine a factory in Jubail for violating the provisions of the Implementing Regulations, and the factory continued the violation. It imposed on it a daily fine of no more than 10% of the limit stated in Article 32 for each day it continues the violation from the date specified in the decision, with publication of a summary of the decision in a local newspaper at its expense after it becomes final.
