Article 32 explained in plain English
This is the Law's general penalties article, and it applies to anyone who violates the provisions of the Law, the Implementing Regulations and the conditions of the license and permit, other than the violations in Article 29, which are storing, burning, treating or sinking waste or disposing of it in a way that poses a danger to public health or harm to the environment, and which have their own penalty.
1- Penalties: one or more of the following:
- A fine of no more than SAR 10,000,000 (ten million riyals).
- Suspension of the license or permit for a period not exceeding six months.
- Cancellation of the license or permit.
This is without prejudice to any more severe penalty provided for in another law.
Repeat offenses: the penalty is doubled for the violator in the case of a repeat offense. A repeat offender is one who returns to commit the violation within three years of the date the decision becomes final after the period set by law has passed, or the judgment issued against him becomes final.
2- Classification table: the Minister issues by decision a classification table of violations (other than Article 29 violations) setting the penalties within the limits stated in this article, taking into account the nature of each violation, its gravity and the aggravating and mitigating circumstances. The Center imposes the fine of no more than SAR 100,000 in accordance with the classification table.
So to know the exact fine for a particular violation, one refers to the classification table and not to this article alone, since the article only sets the upper limit.
Article 33 regulates the committee that hears these violations and imposes their penalties, and Article 31 sets out the powers of the court in Article 29 violations.
Anyone against whom a penalty has been imposed under this article should consult a lawyer specialized in administrative matters.
Practical example
A licensed waste transport company in Riyadh failed to comply with one of its license conditions. This is a violation of license conditions and not an Article 29 violation, so it is punished by a fine of no more than ten million riyals, suspension of the license for no more than six months, or its cancellation, according to the classification table. If it repeats the violation within three years of the decision becoming final, the penalty is doubled.
