Article 35 explained in plain English
This article places obligations on the violator in addition to the penalties. It is not enough for the violator to pay the fine or serve the penalty; he must also:
- Remove the effects resulting from the violation, such as removing dumped waste or cleaning the site.
- Carry out rehabilitation, meaning returning the site or the damaged environment to a suitable condition.
- Pay the compensation resulting from the violation.
All of this is as the Implementing Regulations specify. The article does not say how compensation is assessed, who determines it, or what level of rehabilitation is required.
The article is general: it applies to the "violator" without distinguishing between one type of violation and another, as the text does not limit it to a particular category.
These obligations differ from the committee's powers in Article 34, which allows it, in addition to the penalties, to impose a daily fine for continuing the violation of no more than 10% of the amount of the fine, and to include in the decision publication of its summary at the violator's expense. The fine and publication are penalties, whereas removing the effects, rehabilitation and compensation are obligations to repair what the violation has damaged.
Article 36 requires the Minister to issue the Implementing Regulations in coordination with the Minister of Municipal, Rural Affairs and Housing and the Minister of Health within sixty days of the date of publication of the Law.
Anyone obliged to remove effects or pay compensation, or harmed by a violation and wanting to claim, should consult a lawyer specialized in civil matters and compensation.
Practical example
A contractor in Medina dumped demolition waste on vacant land, and a penalty was imposed on him. Under this article, the penalty is not enough: he must also remove the waste from the site, rehabilitate it and pay the compensation resulting from the violation, as the Implementing Regulations specify.
