Article 9 explained in plain English
This article regulates the provisional measures imposed during an investigation:
- Anti-dumping and countervailing: they may be imposed as provisional duties or guarantees if the investigation shows positive preliminary findings that dumped or subsidized imports have caused injury to the domestic industry, and that provisional measures are necessary to prevent injury during the investigation.
- Safeguards: they may be imposed as provisional duties or guarantees in critical circumstances where delay would cause damage that is difficult to repair, on the basis of positive preliminary findings relying on clear evidence that an increase in imports has caused or threatens to cause serious injury.
- Ceiling: provisional anti-dumping and countervailing measures may not exceed the dumping margin or the amount of the subsidy determined by the preliminary findings.
- Refund: provisional duties are refunded and guarantees returned to those who paid them if the investigation ends without final measures, whether for the public interest, for lack of dumping or specific subsidy, for lack of material injury, or because it was not established that the increase in imports caused or threatens serious injury.
- Price undertakings: they may be accepted in anti-dumping and countervailing investigations in the period between the positive preliminary findings and the final findings, and the Authority may end or suspend the investigation concerning the party that gave the undertaking, unless that party asks for it to be completed or the Authority considers this necessary.
This article comes after Article 8, which sets the same rule for final measures, that they may not exceed the dumping margin or the finally determined amount of the subsidy. Article 10 follows, regulating the relationship between provisional and final measures, including imposing final measures retroactively from the date of the provisional measures decision and refunding the difference if the final ones are lower. Anyone who has paid provisional duties or provided guarantees may consult a lawyer specialized in international matters and foreign investment.
Practical example
An importer in Jeddah paid provisional duties on a shipment during an anti-dumping investigation. The investigation then ended without final measures because material injury was not established, so the provisional duties it paid are refunded to it.
