Article 32 explained in plain English
This article is very practical, because it sets how the end of all time limits in the Law is calculated. It contains two rules:
- Extension for holidays: if the end of a period coincides with an official holiday or the weekend, according to the holidays applied in the Kingdom, the period is extended to the day after the end of the holiday.
- Time of expiry: the last day of any time period ends at 3 p.m. Kingdom time, not at midnight.
The practical effect of the second rule is significant: anyone who leaves what they must file until the evening of the last day may find that the period has ended.
This article is linked to Article 31, which binds the Authority to the mandatory time limits in the Law, the Implementing Regulations and the WTO agreements. It is followed by Article 33, which regulates the Authority's representation of the Kingdom before the WTO Dispute Settlement Body and others, and the powers of the Governor and the President in litigation and in implementing final judgments.
The text is general and covers "all time limits", and does not distinguish between one period and another. Anyone nearing the end of a statutory period who needs to be sure how it is calculated may consult a lawyer specialized in administrative matters.
Practical example
An importing company has a deadline that ends on a Friday, which is one of the weekend days in the Kingdom. The deadline extends to the day after the end of the holiday, and that day ends at 3 p.m. Kingdom time, so the company must file what is required before that hour.
