Article 23 explained in plain English
This article completes the confidentiality protection begun in Article 22, setting out when disclosure is permitted and the penalty for violations:
Paragraph 1 - when disclosure is permitted: disclosing any confidential information is prohibited except in one of two cases:
- The written consent of the owners of the information.
- A final court judgment or a binding order from the competent court requiring disclosure, provided that the owners of the information are notified of the judgment or order.
Paragraph 2 - penalty: without prejudice to any more severe penalty in the relevant laws, the Law on Penalties for Publishing and Disclosing Confidential Documents and Information applies to violators of paragraph (1) of Article 22. Paragraph (1) of Article 22 requires the Authority and all participants in and persons with access to the investigations, including board members, employees, contractors and representatives of the Authority, to keep confidential information confidential and not disclose it. This article does not state the amount of the penalty, which is a matter for that law.
Paragraph 3 - what the Implementing Regulations set:
- The conditions for treating information as confidential.
- The cases in which interested parties and persons with a public interest must provide non-confidential summaries of confidential information.
Non-confidential summaries allow the other parties to understand the substance of the information without disclosing its details. Article 24 follows, regulating the grievance to the President against his decision on the final findings. Anyone facing a request to disclose their information, or whose information has been disclosed, may consult a lawyer specialized in criminal matters.
