Article 8 explained in plain English
This article deals with supervision of the application of the law, and has two paragraphs:
Paragraph 1: the Ministry's direct role
- Checking that private establishments apply the provisions of the law.
- Detecting violations.
- Applying the prescribed penalties.
Paragraph 2: the role of government entities in reporting
- The Ministry, in coordination with government entities, sets the procedures needed for those entities to report violating private establishments to the Ministry.
- Reporting is made according to the jurisdiction of each entity, so no entity goes beyond the limits of its jurisdiction.
Under Article 1, government entities are the entities responsible for granting licenses to carry out the activities named in the law. Because of their connection with licensed establishments, these entities may discover violations and report them to the Ministry.
The violations detected are mainly breaches of the obligations in Article 7: joining Shomoos, and recording information fully, correctly and immediately from the start of dealing. Article 9 then sets out the penalties in detail: for failing to join, a warning first, then a fine of SAR 10,000, then SAR 25,000, then suspension of the business; for recording violations, a warning first, then escalating penalties for repetition within six months.
An establishment cited for a violation that wants to know its position can consult a lawyer who specializes in administrative cases and commercial regulations.
