Article 25 explained in plain English
This article directs a specific prohibition at non-government bodies, such as private companies and institutions, preventing them from three things:
- Failing to adhere to the basic principles mentioned in Article 2, which are: non-discrimination on the basis of disability and equal opportunity; providing accessibility requirements and reasonable accommodation; covering the requirements of persons with disabilities in legislation, policies, plans and designs; enabling them to take part in managing their own cases; the capacity of an adult among them to carry out acts unless the disability prevents it; adopting alternative means of communication such as sign language; and training staff in dealing with them.
- Depriving persons with disabilities of the rights and services in the Law.
- Enacting policies that tend to discriminate on the basis of disability, whether directly or indirectly.
The third prohibition is important, because it covers a policy that does not mention disability expressly but whose effect is discrimination against persons with disabilities. This is consistent with the definition of discrimination in Article 1, which covers what has the purpose or effect of impairing rights.
It is followed by Article 26, which sets the penalty for violating this article: a fine of up to SAR 500,000, doubled on repetition, with the possibility of publishing the penalty decision. As for the violations in Article 21, the Public Prosecution investigates them and brings the case under Article 24.
A body that wants to review its policies, or a person who believes they were discriminated against, can consult a lawyer specializing in administrative cases.
Practical example
A private company requires all applicants for an administrative job to pass a test unrelated to the job's requirements, which in practice excludes persons with mobility disabilities. This may amount to enacting a policy that discriminates indirectly on the basis of disability, which paragraph 3 of Article 25 prohibits.
