Article 2 explained in plain English
This article sets out the purpose of the Law, which is to protect and promote the rights of persons with disabilities and ensure they receive all services like others, then lists seven basic principles on which it rests:
- Non-discrimination on the basis of disability, and equal opportunity.
- Providing the requirements of accessibility and reasonable accommodation.
- Legislation, strategies, policies, programs, plans and designs, governmental and non-governmental, must cover the requirements of persons with disabilities.
- Enabling them to take part in managing their own cases in accordance with the provisions regulating this.
- A person with a disability who has reached the age of majority has the capacity to carry out legal acts unless the disability prevents it, in accordance with the relevant legal provisions.
- Adopting alternative and appropriate means of communicating with them, such as verbal or written communication, sign language or others.
- Training the staff who serve them in all bodies in how to deal and communicate with them, and raising awareness of their rights.
These principles are understood with reference to the definitions in Article 1: discrimination on the basis of disability includes whatever has the effect of impairing rights even if unintended. The capacity principle means that disability alone does not take away an adult's right to carry out legal acts, unless it prevents them under the relevant laws. Article 3 then goes on to detail the right of access to physical environments.
Anyone who faces a situation they believe breaches these principles would do well to consult a lawyer specializing in the rights of persons with disabilities or in administrative cases.
Practical example
Sarah is an adult young woman with a hearing disability who wants to open an account and sign a lease herself. Under the capacity principle in Article 2, she may carry out these acts herself unless her disability prevents her under the relevant legal provisions, and one of the Law's principles is to adopt alternative means of communicating with her, such as sign language or writing.
