Article 28 explained in plain English
This article regulates the body that decides on violations by non-government bodies, and contains three provisions:
- Formation: one or more committees are established by decision of the board of directors of the Disability Care Authority, with not fewer than 3 members, among them a Sharia or legal adviser.
- Rules and remuneration: the committee's rules of work are issued, and the remuneration of its chair, members and secretary is set, by decision of the Authority's board of directors, and is paid from the Authority's budget.
- Jurisdiction and grievance: the committee considers violations of Article 25 and imposes the penalties in Article 26. Anyone against whom a penalty decision is issued has the right to file a grievance before the competent court.
The violations meant are: non-government bodies' failure to adhere to the basic principles mentioned in Article 2, depriving persons with disabilities of the rights and services in the Law, and enacting discriminatory policies directly or indirectly. The penalties are a fine of up to SAR 500,000, doubled on repetition, with the possibility of publishing the penalty decision at the body's expense.
The article does not set a period for the grievance, and does not name the competent court. It comes after Article 27, which gives the Authority the work of inspection, oversight and enforcement. A body against which a decision has been issued and that wants to file a grievance can consult a lawyer specializing in administrative cases.
Practical example
The committee issues a decision fining a private establishment in Taif for depriving a person with a disability of a service recognized by the Law. Under Article 28, the establishment has the right to file a grievance against the decision before the competent court.
