Article 24 explained in plain English
This article specifies the competent body for dealing with the violations in Article 21, which is the Public Prosecution, with two tasks:
- Investigating the violations.
- Bringing the case before the competent court.
The violations meant are those in Article 21, which include:
- Assaulting persons with disabilities physically, morally or materially.
- Neglecting them, depriving them of their rights, abusing or mocking them, or exploiting them in any way.
- Impersonating them or giving false information to government and non-government bodies in order to obtain benefits.
In practice, the path for these acts starts with an investigation by the Public Prosecution, then it brings the case before the competent court. The article does not set out notification procedures or deadlines, and does not name the competent court.
This differs from the violations of non-government bodies in Article 25, such as failing to adhere to the basic principles of the Law, depriving persons with disabilities of rights and services, or enacting discriminatory policies; this article does not deal with them. This article comes after Article 23, which allows the court to publish a summary of the judgment at the violator's expense.
Anyone who has been subjected to one of these acts or accused of it can consult a lawyer specializing in criminal cases.
Practical example
A family discovers that a private caregiver working for them neglects their son with a disability and deprives him of food. Under Article 24, the Public Prosecution is competent to investigate this violation, which is covered by Article 21, and to bring the case before the competent court.
