Article 21 explained in plain English
This article specifies the acts that constitute a violation of the provisions of the Law. It applies to any person who commits an act that exposes persons with disabilities to any of the following, in three groups:
- Assault: assaulting them physically, morally or materially.
- Neglect and abuse: neglecting them, depriving them of their rights, abusing or mocking them, or exploiting them in any way.
- Impersonation and false information: impersonating them by any means, or giving false information to government and non-government bodies in order to obtain the benefits covered by this Law or any other laws.
Note that the third group protects persons with disabilities indirectly: someone who impersonates a person with a disability to obtain benefits they are not entitled to infringes the rights of those who are entitled to them.
This division is directly significant, because Article 22 sets a different penalty for each group: the acts in paragraph 1 are punishable by imprisonment of up to two years or a fine of up to SAR 500,000 or both, and those in paragraph 2 by imprisonment of up to one year or a fine of up to SAR 250,000 or both, with the penalty doubled in both paragraphs if the person with a disability is a child or an elderly person. The acts in paragraph 3 are punishable by a fine of not less than SAR 10,000 and not more than SAR 500,000.
Anyone who, or whose relative with a disability, has been subjected to any of these acts can consult a lawyer specializing in criminal cases.
Practical example
A person begs in the markets, exploiting a child with a disability to gain people's sympathy. This act falls within the exploitation of persons with disabilities mentioned in paragraph 2 of Article 21, and is punished under paragraph 2 of Article 22, with the penalty doubled because the person with a disability is a child.
