Article 43 explained in plain English
This article gives the mortgagor and the possessor of the mortgaged property the right to request release of the mortgage in one specific case: the period for hearing a claim on the debt secured by the mortgage has elapsed.
This article does not specify the length of that period but refers to what other laws provide; those laws must therefore be consulted to learn the period applicable to the debt secured by the mortgage.
- Who may make the request: the mortgagor and the possessor.
- Subject of the request: release of the mortgage.
- When it is made: after the period for hearing a claim on the debt secured by the mortgage has elapsed.
- Source of the period: other laws, not this law.
The article speaks of a right to "request" release of the mortgage; it gives the mortgagor and the possessor a means of demanding release after that period has elapsed.
This article sits alongside Article 42, which provides for the extinction of a registered mortgage by the destruction of its subject, subject to the provisions on destruction of the mortgage, and Article 44, which provides that the mortgage is not void on the death of the mortgagor or the mortgagee or on loss of capacity.
Because fixing the period requires consulting other laws and applying them to the facts of the debt, the person concerned would do well to consult a lawyer specializing in real estate cases.
Practical example
A property in Taif still has a registered mortgage recorded on it, securing an old debt. If the period for hearing a claim on that debt, set out in other laws, has elapsed, the mortgagor, or whoever now holds the property as possessor, may request release of the mortgage.
