Article 5 explained in plain English
This article sets out what the committee does to achieve its aim, and gives examples with the words "including", so the list is not exhaustive:
- Seeking reconciliation without coercion, compulsion or pressure, and bringing the views of the parties to the case closer. The victim's heirs must agree willingly.
- Full supervision of the efforts to seek reconciliation in the region.
- Engaging anyone it sees fit to carry out its tasks.
- Proposing branch committees attached to it in the governorates, which are established by decision of the Emir of the Region and are subject to the provisions and conditions of this Regulation.
- Community contribution in matters relating to its tasks.
- Any other task the Emir of the Region assigns to it relating to its objectives, provided it does not conflict with the aim stated in Article 2.
The second paragraph takes on practical importance with Article 11, which requires anyone who wishes to seek reconciliation and is not a committee member to submit a request to it. Reconciliation efforts in the region therefore pass under the committee's supervision.
Anyone with a case who wants to know the committee's role in it may consult a lawyer specializing in criminal cases.
Practical example
In a governorate belonging to a region, qisas cases have become frequent, so the region's committee proposes forming a branch committee there. The Emir of the Region issues a decision establishing it, and it works in accordance with the provisions and conditions of the Regulation and seeks reconciliation without pressure on the victim's heirs.
