Article 6 explained in plain English
This article regulates what the applicant must do after approval of his application under Article 5, that is, after the decision of the head of the Center approving it has been issued.
First: the period and the obligations. Within 30 days of being notified that approval has been issued, the applicant must do two things:
- Pay the fee approved by the Council of Economic and Development Affairs.
- Submit a medical insurance document in accordance with the Cooperative Health Insurance Law and its Implementing Regulations.
Second: the consequence of delay. If the applicant does not meet these two requirements within the specified period, his application submitted under Article 4 is considered cancelled. Approval alone is therefore not enough, and it takes effect only once these steps are completed on time. The period is counted from the date of notification of the approval, not from the date it was issued.
Third: commencement. The article leaves it to the Regulations to specify the date on which the privileged residency begins to take effect and the procedures needed for its issuance; the Law does not specify this itself.
Item (1/a) and item (3) were amended to their current wording by Royal Decree No. (M/84) dated 11/6/1445 AH. Anyone who faces a problem with the deadline or with the acceptance of an insurance document would do well to consult a lawyer specialized in residency and foreign investment affairs.
Practical example
A businessman in Jeddah was notified that his privileged residency application had been approved, but he was busy traveling and did not pay the fee or submit the medical insurance document until 40 days after notification. Under this article his application is considered cancelled because he did not meet the two requirements within 30 days.
