Article 25 explained in plain English
This article contains two routes for a prisoner to leave before completing his full term:
Paragraph (a): conditional release
The Minister of Interior may decide it for any person sentenced to imprisonment on the following conditions:
- He has served three quarters of the sentence in prison, and the period he has served is not less than nine months.
- His conduct in prison inspires confidence in his self-rehabilitation.
- His release does not pose a danger to public security.
- He has met all financial obligations arising from the crime for which he was sentenced.
The release decision specifies the duties imposed on him as to his residence, manner of living and guarantee of good conduct. If something indicating his misconduct is established, the Minister of Interior may return him to prison to complete the sentence imposed.
Paragraph (b): additional pardon period
The Minister of Interior may set an additional pardon period of up to 15% of the sentence of a prisoner who completes education or vocational training programs after enrolling in them and attending them regularly, provided his conduct is good and his release does not pose a danger to public security. The regulations specify the mechanism for implementation. This paragraph was added by Royal Decree No. (M/45) dated 11/9/1430 AH.
Release here is discretionary ("may"), so meeting the conditions does not mean it happens automatically. The article comes after Article (24) on the time of release, and before Article (26), which deducts the period of detention from the sentence imposed. To assess the situation of a particular prisoner, it is advisable to consult a lawyer who specializes in criminal cases.
Practical example
Sultan was sentenced to four years in prison in Riyadh, his conduct was good, and he paid all the financial obligations arising from his crime. After he has served three years (three quarters of the term), the Minister of Interior may release him conditionally unless that poses a danger to public security. If his misconduct is later established, he may be returned to complete the term.
