Article 58 explained in plain English
A plant patent grants rights, but it also places continuing obligations on its owner:
- Maintaining the variety: maintaining the protected variety, or where necessary its genetic components, throughout the period of protection.
- Proving maintenance: supplying the City, at its request, with the information, documents or materials needed to prove that it is maintaining the variety, within the set period.
- Alternative name: proposing a suitable name for the variety if the City strikes out its name, within the set period.
- Samples: supplying the City where necessary, at its request and within the set period, with suitable samples of the variety or its genetic components, to prepare or renew the official sample, or to carry out a comparative examination of other varieties for protection purposes.
Consequence of breach: if the owner breaches any of these obligations, the plant patent lapses, but this does not happen suddenly; it follows:
- notifying the owner that it must perform its obligation;
- and giving it a reasonable period to do so.
In all cases the lapse is recorded in the register and announced in the Bulletin. The lengths of the periods mentioned in the article are not set by the text, which refers them to the Regulations.
Anyone who receives a notice from the City about their obligations would do well to consult a lawyer specializing in intellectual property and patents before the period expires.
Practical example
A farm in Tabuk owns a plant patent for an olive variety, and the City asked it for samples of the variety for a comparative examination. If the farm does not supply the samples within the period, the patent does not lapse immediately; the farm is notified that it must comply and given a reasonable period, and if it does not comply the patent lapses, and this is recorded and announced in the Bulletin.
