Article 56 explained in plain English
This article defines the scope of protection of a plant variety after a plant patent is granted.
A - The basic right: the plant patent owner may bring a case before the Committee against anyone who exploits the propagating material of the protected variety without consent inside the Kingdom. Exploitation includes: producing or reproducing it, conditioning it for propagation, exporting it, importing it, offering it for sale or selling it or any other marketing, and stocking it for any of these purposes.
B - Harvested material: the rights extend to harvested material of the variety, including whole plants or parts of plants, obtained through the unlawful use of propagating material, provided the owner has not had a reasonable opportunity to exercise its rights over the propagating material.
C - Derived varieties: the rights in paragraphs (A) and (B) extend to varieties essentially derived from the protected variety, if they cannot be clearly distinguished from it under the distinctness criterion in paragraph (B) of Article 55, or if their production requires the repeated use of the protected variety.
D - Exceptions: these rights do not extend to acts done:
- for personal, non-commercial purposes;
- for experimental purposes;
- for the purpose of breeding new varieties.
Anyone who deals in seeds or seedlings and fears they may be of a protected variety would do well to consult a lawyer specializing in intellectual property and patents.
Practical example
An agricultural company owns a plant patent for a tomato variety, and then discovered that a nursery in Al-Ahsa was multiplying the variety's seeds and selling them without its consent. Multiplying and selling are forms of exploitation, so the company may bring a case before the Committee. A family planting the seeds in its home garden for personal, non-commercial consumption, however, is not covered by these rights.
