Article 116 explained in plain English
This article sets the officer's salary during standby, and its provisions are:
- The amount: half the actual salary of his rank.
- The start: from the date the decision placing him on standby is issued.
- The paying body: from the treasury of the Ministry of Defense and Aviation.
The exception: the remaining salary is to be paid to him, that is, the other half, if two conditions are met:
- His placement on standby was under paragraph (c) of Article 109, which is placement because of his being accused of committing a crime where the circumstances of the investigation and trial so require, until his matter is decided.
- His innocence is then finally established.
The practical meaning is that an officer on standby receives half his actual salary in all cases. But one who was placed on standby because of an accusation and was then finally acquitted is paid the other half that he did not receive, so he does not bear a financial loss because of an accusation of which he was proved innocent.
Note that payment of the balance is limited to the case of paragraph (c) with final acquittal; it does not extend under this text to the other grounds for standby. A person who was acquitted and was not paid the balance may consult a lawyer specializing in administrative cases and military service matters.
Practical example
Lieutenant Colonel Jaber was placed on standby because he was accused in a case where the investigation circumstances required keeping him away, and he was paid half his actual salary for a full year. A final judgment of his innocence was then issued, so under the article he is paid the other half for that year.
