Article 32 explained in plain English
The addict: a person whose addiction is established by a medical report from a facility designated for this purpose.
Cases in which admission is permitted:
- An addict convicted of the offense of use, provided it is not accompanied by any other offense.
- An addict who possessed, held, bought or received the substances solely with the intent of use, without their exceeding his personal need.
- An addict seized by the authorities on the basis of a report or complaint.
Procedures: the facility sets the length of admission by a medical report, which may not be less than 15 days. The Committee for Considering Addiction Cases then submits its report on his social and health condition and the length of treatment to the Bureau of Investigation and Public Prosecution, which brings the case before the court together with the report, and the addict is admitted by order of the court after the judgment establishing the conviction.
Length of treatment: from 6 months to 2 years, and the court may go below the minimum for compelling reasons.
Who does not benefit: a person who has previously been admitted twice by court order, unless 3 years have passed since the last order, and a person who commits any of the offenses under the Law while being treated in the facility.
Release and extension: the facility releases him once his condition has stabilized, by a medical report, with written notice to the Committee. If an extension is needed, the facility submits a report to the Committee sufficiently before the end of the period, and the extension is issued by the judge who issued the admission order.
Cancellation: the court cancels the treatment order, at the request of the Bureau and based on the Committee's report, if it is shown to be ineffective, or if the addict breaches his treatment obligations or the facility's rules, or commits an offense under the Law during his admission.
Because the cases involve several conditions, the family or the person concerned is well advised to consult a lawyer who specializes in criminal cases.
Practical example
Saad was convicted of using a narcotic substance with no other offense, and his addiction was established by a report from a specialized facility. The Bureau brought the case together with the addiction committee's report, and the court ordered his admission to the facility for treatment of not less than 6 months and not more than 2 years.
