Article 15 explained in plain English
Article 15 gives the Minister of Municipal and Rural Affairs (as defined in Article 1) the power to issue the implementing decisions necessary for the Regulations, with an express limit: that they be within the limits of what its provisions require.
The meaning of this limit is that the implementing decisions elaborate what is in the Regulations and set the procedures for applying it, and do not go beyond its provisions. Under this Article, an implementing decision may not raise a maximum penalty or add a provision that contradicts the Regulations.
These decisions are very important, because the definition of a municipal violation in Article 1 covers failure to comply with the implementing decisions issued under the Regulations.
The Article follows Article 14, which allows supervision and inspection to be assigned to the private sector. It is followed by Article 16, which allows the Minister or his delegate to grant a person who helps in uncovering a violation a reward not exceeding 25% of the fine collected, and to grant outstanding inspectors rewards to improve performance.
Anyone who believes an implementing decision applied to him goes beyond the limits of the Regulations may consult a specialized lawyer in administrative matters (the Board of Grievances).
