Article 11 explained in plain English
Article 11 places two duties on the owner of a shop or establishment or his representative:
- Appearing: appearing before the Amanah or the municipality when it requests him to, in the cases set by the implementing decisions. Not every request to appear falls under this provision, only the cases specified in those decisions.
- Carrying out instructions: carrying out the instructions of the Amanah or the municipality issued by it as established by law.
Effect of breach: The implementing decisions set the measures that follow from failing to comply with these two duties, without prejudice to the penalties provided for in Article 2, namely the fine, closure, and license cancellation for a serious violation.
Note that the duty falls on the owner of the shop or his representative, so it is enough for his representative to appear. A shop and an establishment, according to Article 1, are the location or entity holding a municipal license.
The Article follows Article 10 on buildings erected without a license, and is followed by Article 12, which allows the Amanah or the municipality, where there is strong suspicion that a serious violation has occurred, to seize or impound materials or close the shop for a period not exceeding three days.
Anyone who has been asked to appear before the municipality or has received instructions he considers unlawful may consult a specialized lawyer in administrative matters (the Board of Grievances).
