Article 10 explained in plain English
Article 10 regulates the case of a building erected without a legal license, without prejudice to the penalties in Article 2, and sets three cases for it:
- Conflict with regulation lines: if the building conflicts with the regulation lines, it is removed at the violator's expense. Regulation lines, according to Article 1, are the lines in the approved plan that show the boundaries of the property and separate it from neighboring properties and public property.
- Possibility of correction: if the building does not conflict with the regulation lines, complies with the building laws, and causes no harm to neighbors or causes harm that can be removed, the violator is penalized by paying a quarter of the construction costs of the violating construction and the license fees set by law, and is required to remove the harm if any, and to bring a certificate from an engineering office qualified by the Ministry proving the safety of the structures.
- Harm that cannot be corrected: if the building violates the building laws and causes harm to neighbors that cannot be corrected by removing the source of the harm, it is removed at the violator's expense.
The implementing decisions set the additional procedures needed to apply this Article.
The difference between this Article and Article 9: Article 9 concerns someone who has a license and exceeded it, and the alternative there is paying half the cost of the violating construction, while this Article concerns someone who built with no license at all, and the alternative here is paying a quarter of the costs with the license fees, under the conditions stated.
Anyone who has erected a building without a license and wishes to know which case applies to him may consult a specialized lawyer in real estate and administrative matters.
Practical example
Salem built an annex in the yard of his house in Qassim without a license. The annex does not conflict with the regulation lines, complies with the building laws, and does not harm the neighbors. Under the second case, he pays a quarter of the cost of building the annex and the license fees, and brings a safety certificate from an engineering office qualified by the Ministry.
