Article 1 explained in plain English
This is the definitions Article, on which understanding of the rest of the Law rests. Its main points:
- Mental health care: a branch of public health concerned with preventive, treatment and rehabilitation mental health services.
- Mental treatment facility: any facility that meets the specifications for mental health care and provides diagnosis, treatment and rehabilitation, whether independent or attached to another health facility, in the public and private sectors.
- Mental disorder: an impairment in thinking, mood, perception, memory or other mental abilities. It is severe if it causes impairment in two or more of four functions: sound judgment and the ability to make decisions; normal human behavior compared with local custom; distinguishing reality, having insight into the illness and accepting treatment; and carrying out the basic requirements of life.
- What is not a mental disorder under this Law: mere intellectual disability, immoral behavior, or the use of or addiction to alcohol, drugs, psychotropic substances or medications.
- Mental patient: a person who suffers, or is suspected of suffering, from a mental disorder.
- Practitioners: the psychiatrist, the psychologist, the social worker, the psychiatric nurse, the psychological counselor, the consultant and the specialist in psychiatry, and the treating physician, each with a specified qualification and license.
- Guardian: the person who holds legal guardianship over the person.
- Convalescent homes for mental illnesses: homes that shelter those who have exceeded the treatment period set and still need shelter.
The importance of the description "severe" appears in the later Articles on compulsory admission, as the assessment of risk rests on it. The exclusion of addiction and mere intellectual disability also determines who falls within the Law.
