Arrest and Detention of a Juvenile in the Saudi Juveniles Law Implementing Regulations

Article 4 regulates arresting a juvenile: immediately notifying his guardian, placing him in the Home, banning restraints except on resistance, and informing him of the reasons for arrest and his right to a lawyer.

Article 5, in accordance with Article 6 of the Law, provides that notice to a juvenile of unknown identity placed in the Home is valid if it is given to the Home, with the Ministry of Interior being informed.

وفقاً للحكم الوارد في المادة (السادسة) من النظام، إذا كان الحدث المودع في الدار مجهول الهوية فيكون التبليغ صحيحاً إذا بُلغت الدار، وتشعر وزارة الداخلية بذلك.

Article 6 requires a request to extend a juvenile's detention to be submitted before the period expires; if it expires without an extension decision or the court refuses the request, the juvenile is immediately handed to his guardian.

يقدم طلب تمديد التوقيف مدة أو مدداً متعاقبة، الواردة في المادة (التاسعة) من النظام، قبل انقضائها، وإذا انقضت المدة ولم يصدر قرار بتمديدها أو رفضت المحكمة طلب تمديد الإيقاف؛ فيسلم الحدث إلى ولي أمره أو من يقوم مقامه فوراً.

Article 7 requires the necessary guarantees to be taken from the recipient when a juvenile is handed to his guardian or the person standing in his place, to ensure the juvenile is looked after and not harmed.

عند تسليم الحدث إلى ولي أمره أو من يقوم مقامه؛ تؤخذ الضمانات اللازمة من المستلم بما يكفل الحفاظ على الحدث وعدم إيذائه.
