Article 6 explained in plain English
This article regulates the procedural side of extending a juvenile's detention, and refers to Article 9 of the Juveniles Law for the periods; the text does not set out that article's content or the length of the periods.
It contains two provisions:
- Timing of the request: a request to extend detention, for one or successive periods, is submitted before the period expires. It is not valid to wait until the period ends and then request an extension.
- Effect of no extension: if the period expires without a decision extending it, or the court refuses the request to extend detention, the juvenile is handed to his guardian or the person standing in his place immediately.
The rule is thus that a juvenile does not remain detained after the period ends unless there is an extension decision. This is an important safeguard that prevents detention from continuing without a basis.
On handing over, the necessary guarantees are taken from the recipient to ensure the juvenile is looked after and not harmed, under Article 7. A guardian who believes his son has remained detained after the period expired without an extension decision can consult a lawyer who specializes in criminal and juvenile cases.
Practical example
A 16-year-old boy was detained, and no decision extending his detention was issued before the period expired. Under this article, he is handed immediately to his father, with the necessary guarantees taken from the father to look after him and not harm him.
