Article 1 explained in plain English
This Article is the definitions article: it explains what is meant by words that recur in the Law, so that the other articles are understood in one sense, unless the context of a particular article requires another meaning.
- Judicial costs: sums of money that the obligated person must pay to the competent department under the provisions of the Law and the Implementing Regulations. The Article provides that they do not include costs required of the obligated person during the case that are needed to decide it; those are different sums from the judicial costs the Law regulates.
- The case: the case filed before the courts.
- Requests: everything submitted by litigants or others before the courts that is not part of the case itself.
- The competent department: the department concerned with collecting and refunding judicial costs.
- The Implementing Regulations: the Implementing Regulations of the Law, to which many details are referred.
These definitions matter in practice, as the distinction between a "case" and "requests" determines the type of cost that may be imposed. Article 2 follows to explain that the Law applies to all cases and requests submitted to the courts, with exceptions for specified categories, including general criminal and disciplinary cases, what the personal status courts and the Board of Grievances handle, and certain other cases and requests.
If it is unclear whether what you are submitting to the court counts as a case or a request, you can consult a lawyer specialized in litigation and procedure.
