Article 4 explained in plain English
This article sets out the role and powers of the Insurance Authority. The Authority is the body responsible for regulating insurance business in the Kingdom, and for supervising, overseeing and developing it. It may do whatever is necessary to achieve its objectives, in addition to its powers established by law, and without prejudice to the powers of other bodies.
Main powers:
- Planning and legislation: Setting the national strategy for the insurance sector, and the policies, plans and programs; proposing draft laws or amendments and submitting them to complete the legal procedures.
- Licensing: Setting the licensing requirements for carrying on insurance business, receiving incorporation applications, granting licenses, and setting the requirements specific to each type of insurance.
- Data and statistics: Setting procedures for collecting, keeping and using insurance data, conducting studies, preparing and publishing statistical bulletins and reports, providing official statistics to bodies and individuals, and creating and exchanging databases.
- Investment and public bodies: Contributing to encouraging investment in the sector, proposing mechanisms for developing insurance on the projects and investments of public bodies, and the extent of the need to make insurance mandatory for the activities it supervises.
- Qualification: Preparing programs and courses, training staff, and setting the tests and requirements relating to licensees and their business.
- External relations: Holding conferences and seminars, cooperating with regional and international bodies and organizations, and representing the Kingdom in them.
The phrase "including" means this list gives examples and is not exhaustive. Many of the powers are subject to coordination with the relevant bodies or to the legal procedures. Anyone wishing to carry on insurance business deals with the Authority as the body that sets licensing requirements and grants licenses, and would do well to consult a lawyer who specializes in insurance and commercial cases.
