Article 114 explained in plain English
This article sets the disciplinary penalties for the customs clearance agent and his representatives.
The framework: subject to Article 141, and without prejudice to any civil or criminal liability established by this law or any other law. Article 141 imposes fines, except in the cases treated as smuggling under Article 143, in accordance with rules in the Implementing Regulations, for violations including those concerning customs declarations, import, export, transit, warehouses, temporary admission, re-export and any other customs violation.
Conditions for imposing a penalty:
- It must be imposed by the Director General.
- After the necessary investigation by the competent department of the Administration.
- In proportion to the size of the violation of the obligations imposed on him.
The penalties:
- A warning.
- A financial fine not exceeding SAR 5,000 or its equivalent in the currencies of the Council states.
- Suspension from work for a period not exceeding two years.
- Cancellation of the license and permanent prohibition from practicing the profession.
Grievance: a grievance may be submitted to the Minister or the competent authority within 30 days of the date of notification of the penalty, and the decision of the Minister or the competent authority is final.
A disciplinary penalty therefore does not prevent holding the agent civilly or criminally liable. Article 115 requires the agent to keep a record of his transactions for five years. Anyone against whom a penalty has been issued would do well to consult a lawyer specializing in customs and commercial cases before the thirty-day period lapses.
Practical example
A customs clearance agent in Riyadh repeatedly submitted incomplete declarations. After investigating him, the Director General decided to suspend him from work for six months. He may submit a grievance to the Minister or the competent authority within 30 days of being notified, and the decision issued on his grievance is final.
