Article 111 explained in plain English
This article deals with endorsing the delivery order and its legal effect.
What is meant by endorsement? Writing on the goods delivery order something that transfers it to another person. The article deals with endorsing it to the name of the customs clearance agent or the representatives of the goods owners.
First effect: authorization. This endorsement is considered an authorization to complete the customs procedures on the goods. The agent or representative therefore does not need a separate authorization to complete the procedures once the order has been endorsed to them.
Second effect: relieving the Administration of responsibility. The Administration bears no responsibility arising from delivering the goods to the person to whom the delivery order was endorsed. If customs deliver the goods to the agent to whom the order was endorsed, and a dispute then arises between him and the owner, the Administration is not answerable for that according to the text.
The practical result: the goods owner should take care to endorse the delivery order only to someone they trust, because the endorsement gives the endorsee the power to complete the procedures and receive the goods.
Article 110 sets out from whom the declaration of goods is accepted. Article 112 provides for the customs clearance agent's responsibility for his acts and the acts of his subordinates before importers, exporters and the Administration. Anyone harmed by the conduct of an agent to whom the order was endorsed would do well to consult a lawyer specializing in customs and commercial cases.
Practical example
An importer in Jeddah endorsed the delivery order for his shipment to the name of a customs clearance office. This is an authorization for the office to complete the procedures, and if customs deliver the goods to the office, they bear no responsibility for that.
