Article 113 explained in plain English
This article gives the Director General the power to regulate the customs clearance profession by instructions he issues on the following matters:
- Conditions for granting licenses to practice the customs clearance profession.
- Conditions for granting licenses to practice as a customs clearance agent's representative.
- Procedures for issuing licenses to the agent and the representative.
- The obligations of the agent and his representative.
- Conditions for opening customs clearance offices.
- The number of agents and representatives permitted to work in the customs offices.
- The customs office or offices in which agents are permitted to work.
- Procedures for dispensing with agents and their representatives.
- Procedures for the transfer of representatives between clearance offices.
- Procedures for withdrawing licenses.
- Cases of striking off the entry in the Administration's register.
The article does not set these conditions itself, but refers their details to the Director General's instructions, so those instructions are consulted to know the actual requirements. Note that the Director General also has the power to determine the number of agents permitted and the offices in which they work.
Article 112 provides for the agent's responsibility for his acts and those of his subordinates. Article 114 sets out the penalties the Director General may impose on the agent and his representatives for breaching their obligations, from a warning to cancelling the license, with a right of grievance. Anyone whose license was withdrawn or whose entry was struck off would do well to consult a lawyer specializing in customs and commercial cases.
