Article 6 explained in plain English
This article sets out the obligations of the retirement or insurance body in the home state, that is, the state whose nationality the national holds, as defined in Article 1.
The four obligations:
- Preparing a guide introducing the provisions of its system, including the contribution rates payable and the procedures required to insure the employee or worker, and circulating it to the retirement and insurance bodies in the GCC states.
- Providing the bodies of the GCC states with the insurance forms it uses to apply the Law.
- Opening a bank account in the state of the workplace, to enable employers and retirement and insurance bodies to deposit the amounts due to it.
- Designating the body or administrative unit responsible for following up the application of the Law with its counterparts in the GCC states.
The idea is that an employer in the state of the workplace needs to know the rules of another state in order to apply them to its GCC employee; so the home state's body provides the guide and forms, and opens an account in the employer's own country to make deposits easier.
In practical terms, the employer does not need to transfer contributions out of the state in which it operates, because the home state's body is obliged to open a bank account in the state of the workplace. Article 7 deals with the corresponding obligations of the body of the state of the workplace.
To apply this to a specific case, it is advisable to consult a lawyer who specializes in social insurance and retirement laws.
