Article 36 explained in plain English
This article regulates attachment, which is assigning the member to work temporarily outside his original place. It specifies its forms as being:
- From one force to another force belonging to the same body.
- Or from one area to another.
- Or from one arm to another arm.
- Or from one unit to another unit.
The article sets two basic limits:
- Duration: not exceeding one year, renewable for another year.
- Reason: the attachment must be based on the requirements of work interests or emergency circumstances.
The temporary nature is what distinguishes attachment. The text sets its duration at a year renewable for another year, and does not mention renewal after that. Note that attachment from one force to another is limited to forces belonging to the same body.
The article does not address the member's financial rights during attachment. Anyone who believes his attachment exceeded the set period or was not for one of the reasons stated may consult a lawyer specialized in administrative matters and military service affairs.
Practical example
A decision was issued attaching Sergeant Ibrahim from his unit in the Eastern Region to a unit in the Southern Region for one year because of work needs. His attachment may be renewed for another year, and the first period may not exceed a year.
