Article 15 explained in plain English
This article opens the way back for someone who left the profession because of a penalty. A person whose professional accreditation was struck off or whose license was cancelled under the provisions of the law may request that his accreditation or license be reinstated, on these terms:
- Period: after 3 years from the date the judgment or decision of striking-off or cancellation was issued.
- Body: the request is submitted to the competent body. The article does not name it, but Article 1 defines professional accreditation as registration with the Authority and licensing as what the Ministry grants to engineering offices and companies.
- Conditions and procedures: the conditions and procedures required for accreditation are followed in the request for reinstatement, so reinstatement is not automatic once the period has passed.
Note that the period runs from the date the judgment or decision is issued, not from the date it is carried out or becomes known.
This article ties in with Article 14, under which detecting violations of the law and its regulations is carried out by Authority employees named by the Minister; striking-off or cancellation results from a violation that was detected and heard under the law. The article does not state the details of the conditions and procedures it refers to. Anyone who wishes to have his accreditation or license reinstated would do well to consult a lawyer who specializes in administrative cases.
Practical example
An engineer in Khobar had his accreditation struck off by a final decision. After 3 years from the date the decision was issued, he may request reinstatement of his accreditation, and his request is subject to the conditions and procedures required for accreditation.
