Article 12 explained in plain English
This article regulates the other violations arising from the application of the law, that is, those other than the violations heard by the court under Article 11. It contains three provisions:
1- The committee and its penalties: one or more committees are formed by decision of the Minister, each with no fewer than three members, including a legal adviser. It imposes one or more of the following penalties:
- Reprimand.
- Warning.
- Suspension of professional accreditation for a period not exceeding 6 months.
- A fine of up to SAR 100,000.
- Striking off professional accreditation.
- Cancellation of the license.
2- Decisions and challenge: decisions are issued by a majority of the members, must be reasoned, and are approved by decision of the Minister. A person against whom a decision is issued has the right to challenge it before the Board of Grievances in accordance with its law.
3- Coupled violations: if the violation within the committee's competence is coupled with another violation within the court's competence under Article 11, the committee must refer the violation to the Bureau of Investigation and Public Prosecution for investigation and prosecution, and the competent court hears it and applies the penalties in the law.
The penalties here have effects tied to other articles: practicing the profession during suspension or after striking-off, or an office practicing after its license is cancelled, is punished under Article 11. Under Article 13, a final decision imposing a penalty may provide for its publication at the violator's expense in 3 local newspapers. Anyone against whom a decision is issued would do well to consult a lawyer who specializes in administrative cases.
Practical example
The committee issued a decision suspending the accreditation of an engineer in Riyadh for 4 months because of one of the law's other violations. He may challenge the decision before the Board of Grievances in accordance with its law, and he may not practice the profession during the suspension.
