Article 4 explained in plain English
First: notifying the sites. The Ministry of Municipal and Rural Affairs must notify the Ministry of Finance (the State Properties Authority) of the sites allocated to public uses in plans that are approved, within a period of no more than 30 days from the date of the plan's final approval.
Second: taking and compensating this land. Land allocated to public uses that the statutory percentage does not cover is taken under the provisions of the law, and the assessment committee assesses the compensation for it on one of two bases according to when it is paid:
- If compensation is paid within two years of the date of allocation: It is assessed at the price per square meter of the land undivided (before planning).
- If it is paid after two years from the date of allocation: It is assessed at the price per square meter at the time.
The practical meaning for the owner is that delay in paying compensation beyond two years from the date of allocation moves the basis of assessment from the land's price before planning to its price when paid. Land that falls within the statutory percentage is not addressed by this paragraph, which is limited to what that percentage does not cover.
Anyone part of whose land has been allocated to a public use in an approved plan can consult a lawyer specializing in real estate matters to assess his position.
Practical example
Part of Saad's land was allocated in an approved plan to a mosque outside the statutory percentage. If his compensation is paid within two years of the allocation, it is assessed at the price per meter of the land undivided before planning, and if it is paid after two years, at the price per meter at the time of payment.
