Article 25 explained in plain English
1. The technical committee: formed by the project owner with the participation of a representative of the Ministry of Finance, to assess:
- The cost of repairing the damage and harm that has affected the property through use.
- The time needed to repair it.
It prepares a report recording the condition of the property and the harm it has suffered, signed by its members and the owner or the holder of the right or their representatives.
Non-attendance: if any of them does not attend after being properly notified and without an acceptable excuse, the committee completes its work and signs its report.
Reservation: if any of them objects to the extent or type of damage or the costs recorded, he may record his reservation and sign it, and this does not affect his receiving the property.
2. The assessment committee: where the technical committee's report is objected to, the assessment committee reviews it, verifies the damage, and prepares a report on the type and extent of the damage, how to remedy it and its costs. It may use specialists, decides by majority, and completes its task within a period not exceeding 90 days of being assigned.
In practical terms for the owner, attending at the inspection is important, because his absence without excuse does not stop the committee's work. If he is not satisfied with the assessment, he records his reservation and receives his property, and the assessment committee then considers his objection. Anyone with a dispute over the assessment of damage can consult a lawyer specializing in real estate or compensation cases.
Practical example
Yousef received his land in Riyadh after the temporary taking ended and found that the technical committee had assessed less damage than he believed. He recorded his reservation on the report, signed it and received his land, and the assessment committee then considered his objection.
