Article 142 explained in plain English
This article of the Implementing Regulations of the Criminal Procedure Law sets out the accepted form of objection to a judgment and where it is submitted:
- A mandatory memorandum: an objection to a judgment is accepted only by a memorandum containing what paragraph 1 of Article 195 of the Law provides; this article does not state the details of that content.
- The public prosecutor may send his memorandum by official letter.
- The memorandum is lodged with the administration of the court that issued the judgment within the period set for objection.
- More than one memorandum: the objector may lodge more than one objection memorandum against the same judgment with the court that issued it, on two conditions:
- That he lodges them within the period set for objection.
- And that this is before the case is referred to the Court of Appeal.
In practice, an oral or unwritten objection is not enough, and the memorandum is submitted to the court that issued the judgment, not directly to the Court of Appeal. A person who missed something in his first memorandum may lodge an additional memorandum if both conditions are met.
The article is linked to Article 141, which explains the effect of not submitting the objection within its period, and to Article 143, which requires the circuit that issued the judgment to record in the case record that it has seen the objection memorandum. To prepare a complete objection memorandum, you can seek the help of a lawyer who specializes in criminal cases.
Practical example
A criminal judgment was issued against Bandar in Riyadh, and he lodged an objection memorandum with the administration of the court that issued the judgment. A few days later, before the objection period ended and before the case was referred to the Court of Appeal, he lodged a second memorandum adding new grounds, which is permitted under this article.
