Article 141 explained in plain English
This article of the Implementing Regulations of the Criminal Procedure Law sets what follows from not submitting the objection to the judgment within the period set for it, and distinguishes between two types of judgments:
- A judgment not subject to mandatory review: if the objector does not submit his objection within the period:
- His right to request appeal or review is lost.
- The judgment acquires finality.
- The competent circuit must annotate that on the case record, the judgment instrument and its register.
- A judgment subject to mandatory review: if the person objecting to it does not submit his objection within the period:
- His right to submit the objection memorandum is lost.
- The competent circuit must annotate that on the case record, the judgment instrument and its register.
The important difference is that the article expressly provides for the judgment to acquire finality in the first case only; in the second it is limited to losing the right to submit the objection memorandum, and does not state that the judgment becomes final. Nor does the article explain what happens afterwards to a judgment subject to mandatory review.
The article is linked to Article 140, which provides that withdrawing an objection does not lose the right to it unless the period passes, and to Article 142, which requires the objection to be submitted by a memorandum lodged within the period with the court that issued the judgment. If you fear missing the objection period, it is best to consult a lawyer who specializes in criminal cases immediately.
Practical example
A criminal judgment not subject to mandatory review was issued against Rashid in Tabuk, and he did not submit his objection within the set period. His right to request appeal was lost, the judgment acquired finality, and the circuit annotated that on the case record, the judgment instrument and its register.
