Article 22 explained in plain English
This article completes the system for deciding insurance disputes by creating a second level, in four paragraphs:
- The Appeal Committee: formed of at least three advisors, full-time if possible, who are specialists with experience in the jurisprudence of transactions and insurance. It hears grievances filed by interested parties against the Primary Committees' decisions provided for in Article 20. Its decisions are final and not subject to grievance.
- Appointment and term: a royal order names the committee's chairman and members, and the term of membership is 3 years, renewable.
- Rules of work: the Council of Ministers issues the rules and procedures for the work of the committees provided for in the law and for bringing claims before them.
- Remuneration: the Minister of Finance sets the remuneration of committee members.
Referring back to Article 20, the Primary Committees decide insurance contract disputes between companies and their customers and beneficiaries, and disputes between sector companies, and hear grievances against Central Bank penalties and license cancellation decisions. All of these decisions can be challenged before the Appeal Committee, and the Appeal Committee's decision is the final word.
The article does not set a deadline for a grievance before the Appeal Committee, so one must refer to the rules and procedures for the committees' work issued by the Council of Ministers. Amendment: this article was amended by Royal Decree No. M/30 dated 27/5/1434 AH. Anyone who has received a primary decision against them should consult a lawyer specialized in insurance and financial-sector matters before the grievance deadlines pass.
Practical example
The Primary Committee issues a decision rejecting Sara's claim for compensation from an insurance company in Riyadh. She may file a grievance against the decision before the Appeal Committee, and what the Appeal Committee decides is final and not subject to grievance.
