Article 26 explained in plain English
This article is the list of violations in the law. The following acts are considered violations:
- Possessing, selling, leasing, making available, making, producing or trading in, in any form, any device, tool, service, system or software relating to communications or information technology that does not comply with the approved technical specifications and standards or with the Authority's requirements and controls.
- Engaging in an activity that requires a license, registration or permit before obtaining it.
- Providing misleading information to the public or to the competent bodies relating to communications or information technology services.
- Obstructing the work of an inspector.
- Misusing communications or information technology services.
- Any practice that undermines competition in the sector.
- Harming communications networks, interfering with them or cutting them, or making unlawful use of them, or disrupting communications or preventing the exchange of information, whether intentionally, through negligence or through default.
- Failing to provide the Authority with the reports, information or documents it requests.
- Possessing any communications or information technology device without the necessary license.
- Any other act that violates the law, the Implementing Regulations or the Authority's regulatory decisions.
Note that the violation in item 7 arises even through unintentional negligence or default, and that item 10 makes the list open-ended. The penalties are set by Article 27, including a fine of up to SAR 25 million, suspension of service, deprivation of a license and blocking of a digital content platform, and they cover anyone who attempted the violation or helped in it. The powers of the inspector, whose obstruction is a violation, are set out in Article 25. Anyone accused of a violation should consult a lawyer specializing in communications and information technology law.
Practical example
A contractor was digging in a street in Riyadh without checking the cable routes, cut a telecom cable, and service went down for an entire neighborhood. This is a violation even if he did not intend it, because the article covers harming or cutting networks through negligence or default.
