Article 46 explained in plain English
A maritime lien means that the creditor has priority in collecting his debt from the ship. This article specifies the debts that enjoy this right:
- Court costs spent to preserve the ship, sell it and distribute its price.
- Debts under maritime employment contracts of the master, the crew and others, including social insurance contributions.
- Fees and taxes due to the State, and port, pilotage and towage dues, and the costs of pursuit, follow-up, guarding, maintenance and other maritime services.
- Salvage rewards and the ship's share in general average (common maritime losses).
- Compensation for collision, pollution and navigation accidents, for damage to port installations, docks and navigation routes, for death and bodily injury to passengers, the master and the crew, and for loss of or damage to goods and baggage.
- Debts arising from the master's contracts and operations outside the ship's port of registry within the limits of his legal authority, for an actual need of maintaining the ship or continuing the voyage, whether or not he is the owner, and whether the debt is owed to him, to the supplier, to lenders, to those who repaired the ship or to other contracting parties; also debts incurred by the ship operator because of acts performed by the shipping agent.
In practical terms, a sailor who has not been paid, a port that has not collected its fees, or a person harmed in a collision holds a lien on the ship. This article does not state the ranking of these debts among themselves. A person owed a debt by a ship may consult a lawyer specializing in commercial cases to find out whether it is a privileged debt.
Practical example
A sailor worked on a cargo ship for three months without receiving his wages. His debt arising from the maritime employment contract is one of the debts carrying a lien on the ship under paragraph 2.
