Article 377 explained in plain English
This article sets a penalty of a fine of not less than SAR 10,000 and not more than SAR 100,000 for:
- The person addressed: every master or operator of a ship flying the Kingdom's flag.
The punishable acts:
- Sailing the ship without a valid certificate of the certificates referred to in the Law.
- Sailing a ship that has been ordered suspended or barred from sailing.
The article does not list the certificates it means but refers to the certificates referred to in the Law. Note that the text requires the certificate to be valid; an expired certificate is not enough.
Civil liability: the penalty applies without prejudice to the provisions on civil liability, meaning that paying the fine does not remove the duty to compensate for any damage the violation may cause.
Article 376 punishes a master who does not respond to a distress call without an acceptable justification, and the operator if the violation is on his express instructions. Article 378 punishes with the same fine anyone who disrupts or obstructs the work of maritime inspection delegates or experts of classification societies authorized by the Authority. Anyone facing a violation of this kind should consult a lawyer who specializes in criminal and maritime cases.
Practical example
One of the certificates required by law for a ship flying the Kingdom's flag expired, and its operator sailed it from the port of Jeddah without renewing it. He is punished with a fine of not less than SAR 10,000 and not more than SAR 100,000, without prejudice to the provisions on civil liability.
