Article 282 explained in plain English
Before the goods are delivered, their owners may be asked to provide cash sums to guarantee their contribution to the joint loss. This Article sets rules to protect these sums:
- Immediate deposit: they must be deposited at once in a joint account.
- Name of the account: opened in the name of a representative of the operator and a representative of the cargo owners who provided the sums.
- The bank: one of the banks the parties agree on.
- The purpose: the sums are kept to guarantee payment of the rights of the parties concerned in the joint loss.
- Payment and return: no payments may be made from them or returned to the person who paid them except with written permission from the person carrying out the final settlement.
In case of disagreement (paragraph 2): the competent court appoints a representative of the cargo owners, and appoints the bank in which the sums are deposited.
The provision prevents the operator from dealing with the sums alone, and protects cargo owners until the settlement is complete. Article 281 provides that the expenses of collecting the share of anyone who did not pay are accepted in the joint loss, and Article 283 provides that the joint loss is distributed among all parties concerned in the voyage.
Practical example
A company in Jeddah was asked to provide a cash sum to guarantee its goods' contribution to a joint loss before taking delivery. The sum must be deposited at once in a joint account in the name of a representative of the operator and a representative of the cargo owners at an agreed bank, and nothing is paid out of it except with written permission from the person carrying out the final settlement.
