Article 280 explained in plain English
This Article sets the method of calculating joint loss, dividing the obligations and rights into two groups:
The debit group (those who contribute to the loss):
- The ship: at its value at the port where the voyage ends, plus the value of the loss it bore.
- The freight: the gross freight for carrying goods and the fare for carrying persons whose entitlement was not stipulated in all cases, to the extent of two-thirds.
- The goods: what was saved at its real commercial value at the port of discharge, and what was sacrificed at its estimated commercial value at the same port.
The credit group (damage and expenses that count as joint loss):
- Damage to the ship: valued at the port where the voyage ends, on the basis of the actual repair expenses, or the estimated ones if it was not repaired. In case of total loss or its being treated as such: its value in sound condition before the incident, after deducting the estimated value of repairs that are not joint loss, and the sale price of the wreck if any.
- Damage to the goods: valued at the port of discharge on the basis of their commercial value in sound condition, and in case of damage by the difference between their value sound and damaged, on the last day of the ship's discharge at the port first designated for its arrival or the day the voyage ends if it ends elsewhere. If the damaged goods are sold, the damage is the difference between the net sale price and their value sound on the same date.
Article 281 provides that the expenses of collecting the share of anyone who did not pay his portion are accepted in the joint loss. The details of the calculation are technical, and it is advisable to consult a lawyer specializing in maritime matters on them.
Practical example
A ship's voyage ended at the port of Jeddah after the master threw part of the cargo overboard to save it. The debit group includes the ship at its value in Jeddah with the loss it bore, two-thirds of the freight, and the surviving goods at their commercial value there. The credit group includes the value of the jettisoned goods and the ship's damage valued under the Article's rules.
