Article 225 explained in plain English
This article regulates the travel ticket in a contract for the carriage of persons by sea.
First: the means of proof. A contract for the carriage of persons by sea is proved by a document called a travel ticket.
Second: the particulars of the ticket. The ticket must specifically state:
- The name of the carrier, and the name and nationality of the passenger.
- The date the ticket was issued.
- The name and nationality of the ship.
- The port of departure and its date, the port of arrival and its date, and the intermediate ports designated for the ship to call at.
- The fare.
- The class of accommodation on board.
Third: assignment of the ticket. A travel ticket may not be assigned to another person except with the carrier's consent. A passenger therefore cannot sell the ticket or hand it to someone else without the carrier's consent.
Under Article 1, a passenger is a person carried by the ship other than the master, the crew members and others working on board.
It is preceded by Article 224 on arbitration in the carriage of goods. It is followed by Article 226, which allows the travel ticket to be replaced by another document on small ships or ships operating within the port or in specified areas. Sea travelers are advised to check the ticket particulars when buying, and to consult a lawyer specialized in maritime law if a dispute arises.
Practical example
Saad booked a ticket on a ferry from the port of Duba, then wanted to give it to his brother instead. He may not do so without the carrier's consent.
