Article 1 explained in plain English
This article specifies the meaning of a "commercial datum" in applying this Law. It is a broad definition covering any statement relating, directly or indirectly, to any of the following:
- Quantity, price and dates: the number of goods, their quantity, size, measure, capacity, weight, price, the date of production, or the expiry date.
- Origin: the place or country where they were made or produced.
- Composition: the elements that go into their composition.
- The producer or manufacturer: his name or attributes.
- Rights and awards: the existence of patents or other industrial property rights, or any privileges, awards or commercial or industrial advantages.
- The known name or form: the name or form by which certain goods are known or which they ordinarily take.
The importance of this definition is that everything falling within it is subject to the provisions of the Law, including what Article 2 provides, that a commercial datum must be written in Arabic at least and be true in all respects, wherever it is placed: on products, shops, packaging, invoices or means of advertising.
Paragraph (a) of this article was amended by Royal Decree No. M/11 dated 7/2/1427 AH, and the text shown above is the text in force. In practice, a trader or importer should treat any information he writes about his goods, such as price, weight or country of manufacture, as a commercial datum subject to the Law. Where an assessment of a particular product is needed, a lawyer who specializes in commercial cases can be consulted.
Practical example
A company in Riyadh sells jars of honey with the weight, country of origin and expiry date written on them, and a statement about an award the product received. Under this article, all this information counts as commercial data, so it is subject to the provisions of the Law.
