Article 5 explained in plain English
This Article states the fee for registration in the commercial agencies register, the register in which Article 3 requires registration before carrying on the business of a commercial agent.
Its rule is clear:
- The fee is SAR 500.
- It is the same amount for an individual merchant and for a company, with no distinction between them.
- The fee is paid once; the text did not make it a recurring fee.
This is the text in force of the Article as amended by Royal Decree No. M/8 dated 20/3/1393 AH. The text does not address any other fees or service charges that other bodies may impose; it is limited to the fee for registration in the agencies register.
In practical terms, the individual merchant or company must pay this fee when submitting the registration application with the documents justifying it. Not being registered exposes anyone who carries on the business of a commercial agent to the penalty set in Article 4 for anyone who violates the Law's provisions: a fine of not less than SAR 5,000 and not more than SAR 50,000, with publication of the penalty at the violator's expense.
To confirm the fees and procedures currently applied to a particular case, you can contact the Ministry of Commerce or consult a lawyer specialized in commercial cases and agencies.
Practical example
A company in Riyadh wanted to register its agency for an electronics brand in the agencies register. Under this Article it pays a registration fee of SAR 500 once, the same amount an individual merchant pays to register their agency.
