Article 41 explained in plain English
This article defines the scope of the Law's application to a special category, charitable organizations established by royal orders. As a rule the provisions of the Law of Civil Society Associations and Organizations apply to them as they do to others.
However, the article makes two exceptions to this rule:
- Anything for which the organization's basic statute contains a special provision: if the basic statute of a charitable organization established by royal order contains a special provision on a matter, that provision is applied in place of the provision of this Law.
- Provisions the Council of Ministers decides do not apply to those organizations: the Council of Ministers may exempt particular provisions from applying to them.
The Law thus combines two things: placing these organizations under a unified regulatory framework, and respecting what their basic statutes provide or what the Council of Ministers decides.
In practice, to know the rule that applies to a charitable organization established by royal order on a particular matter, one looks first at its basic statute, then at what the Council of Ministers has decided, and if there is no exception this Law is applied. The article itself does not say which provisions the Council of Ministers has decided to exempt.
